Women awarded $3.6 million in first Bard IVC filter injury case.

A federal jury in Phoenix awarded a woman $3.6 million ($1.6 million for failure to warn of the risks of the filter and $2 million in punitive damages) for proven injuries. Her injuries resulted from a defective implanted device meant to prevent blood clots. C.R. Bard was the manufacturer of the inferior vena cava (IVC) filter that is said to have harmed the plaintiff, Sherr-Una Booker.

Ms. Booker had to undergo open heart surgery to remove a piece of the implant that fractured, tilted and migrated. Not only did the piece migrate, it perforated her inferior vena cava. In light of this, she stated that she fears further injury if any pieces break free from the remaining piece still embedded in her IVC wall. Her original IVC filter implant took place on June 21, 2007.

Setting Precedent for Future IVC Filter Injury Claims

The outcome of this bellwether trial case could help pave the way for global negotiations. Ms. Booker hopes that her win will helps other people injured as well as make Bard accept responsibility for their defective filters and their failure to properly warn medical providers about known potential risks.

As a matter of fact, there are currently over 3,600 cases pending trial in the District of Arizona multi-district litigation (MDL 2641).

Complications from Metal-on-Metal Hip Replacements Skyrocketing

People who developed painful complications after hip replacements have filed over 28,000 lawsuits against manufacturers of defective hip implants. These companies have spent billions of dollars settling the cases, even as more people file lawsuits.

Metal-on-metal (MoM) hip implants are a type of implant that, put simply, fits a metal ball into a metal cup. MoM hip devices were at first considered more durable, but some studies have shown faster deterioration and higher failures.

In some instances, a design flaw causes metallosis, or poisoning caused by elevated levels of toxic metals in the blood, which occurs when metal particles shed dangerously into the body. This condition can also cause bone erosion and tissue death.

Biomet, DePuy, and Stryker are the manufacturers with the most lawsuits for the MoM hip implants. If you or a loved one has symptoms of joint failure or recently had corrective hip surgery, you should ask your surgeon which brand of hip replacement was used.

A recent multidistrict litigation verdict involved DePuy, a division of Johnson & Johnson. After a lengthy trial, a jury awarded $247 million in damages to six patients whose DePuy hip implants failed and had to be surgically removed.

Finally, a Stryker hip plant failure may result in a severe allergic reaction to metal entering hip tissue. Thus leading to false brain tumors and other issues. In addition, bone loss, tissue swelling and death, and loosening of the joint leading to problems walking or need for surgery are possible symptoms.

  4. You should limit the number of passengers, as well as the level of activity inside the car. 
    Most state’s graduated driver licensing laws prohibit teens from having teenage passengers in the car with them during their early months of driving solo. Driving with friends can create a dangerous driving environment because novice drivers are focused on their friends rather than the road.
  5. Avoid eating while driving.
    Being busy is no excuse for distracted driving. Finishing your breakfast on the way to work or school may seem like a time-saver, but it means you are less attentive to the drivers around you. Food spills are a major cause of distraction.
  6. Do your multi-tasking outside the car.
    Everyone spends a lot of time in their vehicles, and it may seem like the perfect time to get little things done: calling friends, searching for good music, maybe even text messaging. Don’t do it. Focus on the road and the drivers around you. Get everything settled before you start driving.
